Child Alimony in Dubai
In Dubai, child alimony is regulated by two key legal frameworks depending on the nature of the family law case:
- Federal Decree-Law No. (41) of 2024 (personal status law).
- Federal Decree-Law No. (41) of 2022 (civil personal status).
Both outline a parent’s legal responsibility to financially support their child, especially after separation or divorce.
Who Pays Child Alimony?
- The father is typically responsible for supporting the child financially, regardless of custody.
- The mother may be liable if the father is absent, unable to pay, or legally exempt.
- In civil personal status cases, the court may assign financial responsibility based on both parents’ solvency, determined by an expert report.
What Is Included in Child Alimony?
Under Article 95 and Article 106 of the Personal Status Law, child alimony includes:
- Food and groceries.
- Clothing appropriate to age and season.
- Housing or rental contribution.
- Medical expenses, including emergencies.
- Education costs, including tuition and school materials.
- Expenses related to breastfeeding, in case the mother is unable to breastfeed her child.
The goal is to preserve the child’s living standard based on the father’s means and the child’s needs.
How Long Must Alimony Be Paid?
- For girls: Until marriage or independent income.
- For boys: Until they are able to earn a living or complete studies with reasonable success.
- If the child is disabled or incapable of earning, alimony continues indefinitely.
These guidelines apply in both personal status and civil personal status cases.
Can Alimony Be Increased or Decreased?
Yes. Article (97) allows either parent to request a modification of the amount:
- Changes are allowed one year after the final judgment, unless exceptional circumstances exist.
- The court evaluates changes in financial status or the needs of the child.
- Increases can be backdated up to 6 months. Reductions apply from the judgment date.
What If a Parent Refuses to Pay?
If a parent neglects their financial obligation, the other parent can:
- File a claim in family court.
- Request temporary alimony during trial proceedings (Article 100).
- Enforce judgments through the court, as child alimony is a privileged debt (Article 98).
Under the Federal Decree-Law No. (41) of 2022, specific to civil personal status cases, the rules are:
- The mother may apply for child-related expenses post-divorce.
- The judge considers marriage duration, parental income, age of children, and parental conduct.
- Alimony obligations during joint custody may apply for up to two years, based on an expert’s financial report.
- Annual reassessment is permitted if circumstances change.
