Termination of Alimony in Dubai
One of the most direct reasons to end alimony is the recipient’s remarriage.
Decree-Law No. 41 of 2024 on personal status states that the wife loses her right to alimony if she remarries during or after the waiting period.
Likewise, Decree-Law No. 41 of 2022 on civil personal status automatically ends alimony as soon as a new marriage occurs. No new court ruling is needed to stop payments.
In both cases, remarriage cancels the following:
- Ongoing spousal maintenance.
- Compensatory alimony.
- Custody-related financial support.
Failure to meet marital obligations can also cause alimony to stop.
Under Article 103 of Decree-Law No. 41 of 2024, the wife’s right to maintenance ends if she refuses to live in the marital home or denies her husband’s rights without a valid reason.
Decree-Law No. 41 of 2022 allows the court to consider such refusal when reviewing alimony requests after divorce. Courts typically review:
- Whether the recipient caused harm or abandonment.
- Whether she denied lawful marital access.
- Whether her refusal contributed to the divorce.
If the ex-wife becomes financially independent, alimony may no longer be needed.
Decree-Law No. 41 of 2024 allows continued alimony even for a solvent wife during marriage, but post-divorce, financial independence can justify termination.
Under Article 9 of Decree-Law No. 41 of 2022, courts assess the recipient’s financial situation using expert reports. If the court confirms she can support herself, alimony can be stopped. This includes:

Alimony connected to child custody ends when custody ends or conditions change.
In Decree-Law No. 41 of 2024, a father is obligated to provide for children until daughters marry or sons can earn a living.
If the mother loses custody, related support ends. Decree-Law No. 41 of 2022 allows custody-related alimony for a maximum of two years. After that, the father may apply to cancel support. Termination is valid in cases such as:
- The child becomes self-reliant.
- Custody is revoked or legally reassigned.
- The recipient remarries or moves.
Termination also occurs when the alimony duration reaches its legal limit.
Article 102 of Decree-Law No. 41 of 2024 caps compensatory alimony at one year of maintenance if the husband initiated divorce without the wife’s request.
After this period, no further payments are required. Decree-Law No. 41 of 2022 limits custody-related alimony to two years unless renewed by court approval. Courts consider alimony ended if:
- The time limit has been reached.
- No extension is legally filed.
- No hardship or dependency is proven.
